Please read this Agreement carefully. This Agreement includes the Medical Release and Disclosure Authorization I have separately executed, together referred to herein as "Agreement". This is a contract and your signature below indicates that you have read and understand every provision of this Agreement and that you unequivocally agree to all terms, conditions and promises herein. The payment of your deposit further verifies your agreement to the terms of this Agreement.
As consideration for participating with Camp Timberlake (for boys) Camp Merri-Mac (for girls) or any program operated by Merri-Mac/Timberlake, LLC (hereinafter referred to as the "Camp") I, the undersigned participant agree and promise as follows:

RISK OF INJURY, ILLNESS AND ASSUMPTION OF RISKS: I acknowledge that I am fully aware of all aspects of the Camp's programs, activities and risks, and I certify that I am able to participate in all camp activities. I have been given ample opportunity to ask any questions which I may have about activities and the environment to which I may be exposed, and I understand that there are risks of injuries and possibly death from some of the activities at the Camp.
I am aware of the dangers and risks which are inherent in the operation of an overnight camp and in my participation in all Camp activities on or off the premises of the Camp including, but not limited to, those risks that can arise from swimming, boating, hiking, backpacking, athletics, including bodily contact, use of tools and equipment in manual arts, arts and crafts, work projects and other programs, tubing, caving, rafting, creek hiking, biking, archery, riflery, sailing, rock climbing, rappelling, ropes course, canoeing, kayaking, fishing, horseback riding, camping out, outdoor-living skills and vehicular travel.
I understand and agree that I may travel by van, bus, car, raft, canoe, bike or foot over rugged and unpredictable terrain, including steep roads, rivers, mountain passes, slippery slopes and rocks. I am aware of and accept the risks of the foregoing travel methods.
I also understand that due to the location and nature of some of the Camp's activities, cell phone coverage and other forms of communication may be unavailable and prompt medical attention and transport, including transport by ambulance, air and other emergency means, may be significantly delayed. I am aware of and accept the risks associated with these conditions and circumstances.
I understand, accept, and agree to assume that the above described risks may be created or caused by 1) my own actions, inactions, or negligence, 2) the actions, inactions or negligence of other participants, and 3) conditions under which certain Camp and program activities take place, and/or the acts or inactions of the "RELEASEES" identified below. I further understand, accept, and agree to assume that these risks involve risks and dangers ranging from minor injuries, such as scrapes and bruises, to serious or catastrophic bodily injury, including permanent disability, emotional and physical trauma, paralysis, and the possibility of death.
I understand and acknowledge that naturally occurring disease processes (including, but not limited to, the currently widespread novel virus COVID-19 and any animal borne illness) can occur in all environments in which CAMP's activities take place. I acknowledge that CAMP has taken reasonable measures to avoid contact, transmittal, and exposure of these things (including between campers, program participants, employees, and third parties) and that it is ultimately my sole responsibility to ensure that I and/or my child takes appropriate actions to safe-guard ourselves. I understand and agree that by participating and/or by allowing my child to participate at CAMP, I am accepting and assuming the risk that I or my child may be exposed to and become ill as a result of these, and that it is an inherent risk of attending CAMP programs.
RELEASE OF ALL CLAIMS: I, the undersigned, individually, collectively and on behalf of the Camper, do hereby release MERRI-MAC/TIMBERLAKE, LLC, dba CAMP MERRI-MAC, dba CAMP TIMBERLAKE, dba BLACK MOUNTAIN EXPEDITIONS, MERRI-MAC PROPERTIES, LLC and their respective officers, directors, members, managers, shareholders, administrators, agents, employees, staff, and/or volunteers (collectively "RELEASEES") , FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, SUITS, OR DAMAGES ARISING FROM, IN WHOLE OR IN PART, MY PARTICIPATION AT THE CAMP, INCLUDING ANY AND ALL CLAIMS ALLEGED FOR PERSONAL INJURY, WRONGFUL DEATH, EMOTIONAL DISTRESS and/or CLAIMS ARISING FROM RESCUE, EMERGENCY RESPONSE OPERATIONS, and/or ANY MEDICAL CARE PROVIDED WHILE ATTENDING THE CAMP.

PARENTAL INDEMNIFICATION: I FURTHER AGREE AND PROMISE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS EACH AND ALL OF THE RELEASEES FROM ANY AND ALL CLAIMS, SUITS, AND/OR ANY OTHER LEGAL DISPUTES THAT MAY BE BROUGHT BY OR ON BEHALF OF THE CAMPER AND/OR ANY OTHER PARENT OR GUARDIAN FOR ANY CLAIMS ARISING OUT OF ENROLLMENT OR PARTICIPATION WITH THE CAMP, WHETHER OR NOT SUCH CLAIM ARISES OUT OF THE ALLEGED NEGLIGENCE OR OTHER CONDUCT BY ANY OF THE RELEASEES.
RIGHT TO REFUSE AND EXPEL: I understand and agree that the Camp reserves and retains the right, at its sole discretion, to cancel, reject, and/or refuse the application, admission and/or participation from the Camp and/or any of its programs and that the Camp can exercise this right at any time, including expelling participants while attending and/or participating in the Camp's programs. I further understand that in the event the Camp exercises this right, it may, at its sole discretion, retain or refund any and all deposits, fees, tuition, or other moneys paid to the Camp.
PAYMENT AND REFUND POLICY: For all programs between May 21 and August 15, a $1000 deposit is required to reserve a spot for the camper. If the camper is participating in horseback riding, the riding fees are in addition to and due with the deposit. The deposit is applied to the tuition and is, in the event of withdrawal, refundable (less a $300 processing fee) if the Camp receives written notice by January 1. The balance of tuition owed must be received by the Camp by March 1. No refunds of any payments will be made after January 1, whether for withdrawal or session changes, except in the event of documented physical illness of the camper prohibiting participation in camp. In such event, 50% of the unused tuition will be refunded.
In the event that after January 1, the camper shortens his/her session length (e.g. from 4 weeks to 2 weeks, etc.), I understand that I will be required to pay an additional $1000 above the published tuition for the shorter session. Deposits, tuitions and enrollments may not be transferred to other campers.
For programs between August 16 and May 20, there are no refunds available and balances are due 60 days before the first day of the program. In the event of documented physical illness of the camper prohibiting participation in the program, 50% of the unused tuition will be refunded.
CABIN PLACEMENT POLICY: I understand and agree that Camp reserves the right to place each camper in the cabin the Camp feels is best. While careful consideration is given to each cabin request, the final decision rests with the Camp. I agree to support the final decision of the Camp in their cabin assignment for the Camper.
AUTHORIZATION FOR USE OF PHOTOGRAPHS/VIDEO: I understand and agree that I may be photographed and/or video recorded while participating at the Camp. I hereby authorize the Camp to use any photographs, videotapes, motion picture recordings or any other record for publicity, advertising or for any other legitimate purpose.

FORUM SELECTION AND CHOICE OF LAW: I agree that any legal dispute between the Camp or any of the other above described RELEASEES arising out of this Agreement, the Medical Release and Disclosure Form, or my enrollment and/or participation with the Camp shall be governed by the substantive laws of the State of North Carolina and that any such dispute, including mediation and/or lawsuit, shall only be filed or brought in Buncombe County, North Carolina.

INTEGRATION: I understand and agree that this Agreement is a fully integrated contract and supersedes any and all oral and/or written expressions by the Camp whether given directly or indirectly, to us about my experience and participation at the Camp.
